Terms of Service

Effective Date: June 23, 2026

These Terms of Service (“Terms”) constitute a legally binding agreement between Nexus Staffing Group (“Company,” “we,” “us,” or “our”) and you, the user, client, or candidate (“you” or “your”). By accessing our website, submitting applications, engaging our staffing services, or using any of our platforms, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree to these Terms, you must discontinue use of our services immediately.

1. Services Provided

Nexus Staffing Group provides workforce solutions including, but not limited to:

  • Temporary staffing and temp-to-hire placements
  • Direct hire and permanent placement services
  • On-site workforce management
  • Candidate screening, background checks, and skills assessments
  • Employer consulting and HR support services

The Company reserves the right to modify, suspend, or discontinue any service at any time with reasonable notice.

2. Eligibility

To use our services, you must:

  • Be at least 18 years of age
  • Be legally authorized to work in the United States (for candidates)
  • Provide accurate, truthful, and complete information at all times
  • Not be prohibited by applicable law from entering into this agreement

 

3. Candidate Responsibilities

Candidates submitting applications or accepting placements through Nexus Staffing Group agree to:

  • Provide accurate and truthful information on all applications, resumes, and onboarding documents.
  • Notify the Company immediately of any changes to your availability, contact information, or work authorization status.
  • Comply with all policies, procedures, and rules of client worksites where you are placed.
  • Report to assigned assignments on time and provide advance notice of any absence or tardiness.
  • Maintain professional conduct at all times while representing Nexus Staffing Group.
  • Notify us immediately of any workplace injury, incident, or unsafe working condition.
  • Understand that placement does not guarantee continued employment or permanent hire.

 

4. Client Responsibilities

Companies and employers engaging Nexus Staffing Group for staffing solutions agree to:

  • Provide accurate job descriptions, worksite conditions, and requirements prior to placement.
  • Maintain a safe working environment that complies with all applicable federal, state, and local labor laws.
  • Notify Nexus Staffing Group promptly of any issues, incidents, or changes affecting placed workers.
  • Pay all invoices in accordance with agreed-upon terms and schedules.
  • Not directly hire a candidate placed by Nexus Staffing Group without paying the applicable conversion or direct-hire fee as outlined in your service agreement.
  • Treat all placed workers in a manner consistent with applicable anti-discrimination and employment laws.

 

5. Fees and Payment

All service fees, markup rates, and payment terms will be set forth in a separate written agreement or service order between Nexus Staffing Group and the client. Unless otherwise specified:

  • Invoices are due within net 30 days of the invoice date unless otherwise agreed in writing.
  • Late payments are subject to a finance charge of 1.5% per month on outstanding balances.
  • Nexus Staffing Group reserves the right to suspend services for non-payment.
  • Clients are responsible for all costs of collection, including reasonable attorney fees, in the event of non-payment.

 

6. Privacy and Confidentiality

Nexus Staffing Group collects and processes personal information in accordance with applicable privacy laws. By using our services, you agree that we may:

  • Collect and store personal information including name, contact details, work history, and identification documents.
  • Share candidate information with client employers for the purpose of evaluating and completing placements.
  • Conduct background checks, drug screenings, and reference verifications as required.
  • Retain your records for the duration required by applicable law.

7. Non-Solicitation

Client companies agree not to directly solicit, recruit, or hire any candidate introduced through Nexus Staffing Group for a period of twelve (12) months following the candidate’s last assignment, without first paying the applicable conversion fee as set forth in the client service agreement. Violation of this provision entitles Nexus Staffing Group to seek all available legal remedies.

8. Equal Employment Opportunity

We do not discriminate on the basis of race, color, religion, sex, national origin, age, disability, veteran status, sexual orientation, gender identity, or any other characteristic protected by applicable federal, state, or local law. All placement decisions are made based on qualifications, skills, and business need.

9. Limitation of Liability

To the fullest extent permitted by law, Nexus Staffing Group shall not be liable for:

  • Any indirect, incidental, special, or consequential damages arising from your use of our services.
  • The conduct, acts, or omissions of any placed candidate while on assignment.
  • Any losses arising from inaccurate information provided by candidates or clients.
  • Disruptions to services caused by events outside our reasonable control, including natural disasters, labor disputes, or system outages.

Our total liability under any claim arising from these Terms shall not exceed the total fees paid to Nexus Staffing Group in the three (3) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Nexus Staffing Group and its officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising out of or related to: (a) your breach of these Terms; (b) your misuse of our services; (c) any inaccurate information you provided; or (d) your violation of any applicable law or third-party rights.

11. Termination

Nexus Staffing Group reserves the right to terminate or suspend your access to our services, without prior notice, for conduct that violates these Terms, is fraudulent, abusive, or illegal, or is otherwise harmful to the Company, its clients, or candidates. Candidates may end their registration at any time by notifying us in writing. Clients may terminate services in accordance with their executed service agreement.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall first be subject to good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Miami-Dade County, Florida, in accordance with the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit or class-wide arbitration.

13. Modifications to Terms

Nexus Staffing Group reserves the right to update or modify these Terms at any time. Changes will be effective upon posting to our website or delivery of written notice. Your continued use of our services following any modification constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

14. Entire Agreement

These Terms, together with any separately executed service agreements or placement agreements, constitute the entire agreement between you and Nexus Staffing Group regarding the subject matter herein, and supersede all prior negotiations, understandings, or agreements. If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
